Please read these terms and conditions (the “Terms”) carefully before using this website ("the Site"). Use of the Site is subject to compliance with the Terms. If you do not accept these Terms, please refrain from using our Site.

Our Privacy Policy (together with these Terms) sets out the basis on which any personal data we collect from you, or that you provide to us, will be processed by us. We are also registered as a data controller with the Information Commissioner's Office in the United Kingdom under reference: A8562797.

All our products and services are subject separate to the terms and conditions of the applicable agreements governing their use, details of which can be found by following the links on the Site before you agree to purchase the products or services in question.

Access to our Site is permitted on a temporary basis and we reserve the right to withdraw or amend the service we provide on our Site without notice. From time to time we may restrict access to some parts of our Site, or our entire Site, to users who have registered with us.

Our Site and the information contained within it is intended for those who access it from the United Kingdom. If you are viewing our Site from outside the United Kingdom you should note that the information contained within it may not be appropriate for use in other places and may not comply with the laws of any territory outside the United Kingdom. If you choose to access our Site from a country other than the United Kingdom you do so at your own risk and you are responsible for compliance with local laws.

You are wholly responsible for your own use of our Site and the use of our Site by any person using your computer and you must ensure that any such person complies with these Terms.

To use this site and its services you must be over eighteen (18) years of age. You must ensure that the details provided by you when signing up for our service are correct and complete. You must inform us immediately of any changes to the information that you provided when registering by updating your personal details.

MEMBERSHIP ACCESS & PAYMENTS

Wallet Whale is a membership service. In order to obtain the discount card and receive the benefits, there is an initial joining fee and a monthly membership fee. The total amount payable at the time of your application is £34.99. There is also a monthly benefits fee of £19.99, which will be charged every 30 days unless cancelled by you. The monthly fee can be cancelled at any time by contacting our Customer Services on: 03707704660 or by emailing us at customerservices@walletwhale.co.uk . Before accepting your order and during your monthly subscription we reserve the right to carry out a pre-authorisation check of £0.01p against your payment details to ensure your card is still active. All pre-authorisations will be refunded at no cost to you within 3-5 working days. Your payment card will only be charged when the items in your order are ready to be dispatched. All product prices and delivery charges are shown in UK pounds sterling.

Refund/Cancellation of Membership
In order to maintain your ongoing membership, your Membership subscriptions must be paid in accordance with the subscription arrangements that were agreed at the time of joining.

Under the Consumer Protection Regulations, you have the right to withdraw from this Agreement within fourteen (14) days after the signup date without giving any reason. The right to withdraw will cancel this Agreement. It ends on the expiry of fourteen (14) calendar days beginning with the day after the Agreement is concluded which is the day you apply for the service. You can cancel by giving written notice of cancellation to, Yes Solutions Club, Capital Office , Kemp House, 152 - 160 City Road, London, EC1V 2NX. or by email to customerservices@walletwhale.co.uk or telephone 03707704660. If you intend to cancel, you should not use any services you have received under the Agreement.

If you cancel your Membership within fourteen (14) days, you will receive a refund of the Application Fee. There will be no refund in the event you cancel after the (14) calendar days. You must allow at least seven (7) business days from the day of cancellation for your refund to be processed.

If you withdraw from this Agreement after fourteen (14) days, the Company is not obliged to return your Application Fee.

We may choose to cancel your Membership by giving you 14 days’ notice in writing to your last known address or email at the end of any subscription period for which a payment has been made , or to cancel any Membership at any time by giving a pro rata refund of any unexpired portion of an outstanding membership. All refunds will be made within 14 days from the date of cancellation.

If you commit fraud or attempt to commit fraud, we will cancel your Membership without any refund.

If we fail to collect payment your Membership will be suspended until alternative payment details have been provided and payment for your Membership has been received.


DISPATCH OF DISCOUNT CARD

We will endeavour to dispatch your Discount Benefits Card to the Address provided in Your Application as soon as possible after receiving Your Initial Joining Fee Payment. It will usually take up to seven to ten Business Days for Your Card and Welcome pack to be delivered to You.

You should contact Us as soon as possible on 03707704660 or customerservices@walletwhale.co.uk if the Card does not arrive within 14 days of your Initial Payment in order for us to arrange a replacement.


Cancellation and Refunds

The membership can be cancelled by you at any time by contacting us on 03707704660 or customerservices@walletwhale.co.uk and request to cancel your membership.

If you chose to cancel the membership within the initial 14 day cooling off period and after we have begun the supply of membership services to you during the cooling off period in response to the request from you to do so, then you shall be responsible to pay us an amount for the supply of the membership services for the period during which they were supplied to you (ending at the time we receive notice of your cancellation) which is in proportion to what has been supplied in comparison with the full coverage of the agreement. We will then refund any balance owing to you within 5 working days.

In order to receive a refund you must return our goods (your membership card) to us at the following address, and this must be received by us within 14 days:

We recommend you return this via recorded delivery for your security.

If we do not receive these goods within 14 days then you will not be eligible for any refund.

If you choose to cancel your membership after the initial 14 day cooling off period then you will not be eligible for any refund, but no further monthly membership fees will be debited from you.

Whilst we have taken reasonable steps to ensure the accuracy and completeness of the information contained in our Site we accept no responsibility for your use of or inability to use or the results of your use of our Site nor for any errors or omissions contained in our Site nor if our Site is unavailable for any time or any period. We provide the Site "as is". The use of our Site and the materials contained in it are entirely at your own risk.

We shall not be responsible for any direct or indirect:

financial losses (including without limitation loss of income, revenues, data, profits, contracts, use, opportunity, business or anticipated savings); loss of goodwill or reputation; any loss or damage we could not reasonably have expected to foresee or reasonably have expected to occur, which you may suffer and which arises out of or in connection with any errors or omissions contained in our Site or your use of or access to our Site or your inability to use or the results of your use of our Site.

DISPUTES & GOVERNING LAW

These Terms and any dispute or claim arising out of or in connection with them or your use of our Site (including non-contractual disputes or claims) are governed by and interpreted in accordance with the laws of England. The English courts will have non-exclusive jurisdiction over any dispute or claim arising from or related to these Terms or your use of our Site (including non-contractual disputes or claims) provided always that you may bring any proceedings in your country of residence.

PREMIUM GROCERY MEMBERSHIP

As part of your membership to Wallet Whale you will be granted PREMIUM access to a 3rd party online Grocery shopping service FREE OF CHARGE. This benefit will continue for as long as you are a member of Wallet Whale but will cease to remain active if you cancel or don’t pay your membership fee.

GUARANTEED PHONE CONTRACTS

Guaranteed Phone Contract is not provided by Wallet Whale but several third party companies. You are guaranteed a phone contract unless you currently have an account with one of the third party entities or you have had an account with one of them in the past. If you are not able to get a phone contract, you will be eligible for a refund.

REFUNDS AGAINST FREE/ PROMOTIONAL ITEMS

It is at our discretion to issue a refund or replacement for any free/ promotional items the user has ordered.

AMAZON VOUCHER TERMS AND CONDITIONS

To qualify for your £10 Amazon Voucher you must successfully complete a review via the link provided by Yes Solutions Limited.
Only reviews completed via invitation from Yes Solution Limited will be valid for the redemption of an Amazon Voucher.
No cash alternatives will be offered.
